## Who Decides on Data Centers Near Lansing

DATA CENTER: NEWS, INFORMATION & RESOURCE CENTER FOR LANSING

Greater Lansing has become mid-Michigan's data-center test case, with a repealed zoning district, a successful recall, and township moratoriums all within a short drive of the Capitol.

A data center in or near Lansing would first need local land-use approval through City of Lansing, and Ingham County weighs in on land outside city limits and on tax incentives. The Michigan Public Service Commission is the state utility regulator; it reviews rates and large-customer power contracts for the utilities it oversees. Air and water permits come from the Michigan Department of Environment, Great Lakes, and Energy (EGLE).

**National context:** Federal energy researchers estimate data centers used about 4.4% of all U.S. electricity in 2023 and could use 6.7% to 12% by 2028, which is why utility commissions, local boards, and voters are now central to where these campuses land. ### What’s on file near Lansing

- **City of Mason, Ingham County**In February 2026 the City Council adopted Ordinance 266, creating an M-3 Technology Innovation District with noise, setback, and screening rules for data centers. Residents filed 755 valid referendum signatures, more than the 600 needed, and on March 16, 2026 the council voted 4-2 to repeal the ordinance rather than send it to the August ballot. The city notes the repeal leaves data centers under older general manufacturing (M-2) rules. On Nov. 3, 2026, voters recalled Council Member Elaine Ferris, who had voted for the district, and elected Pamela Oliver to the seat. A separate recall drive aimed at Mayor Russell Whipple is targeting May 2027.
- **Vevay Township, Ingham County**An attorney for an unnamed client asked the City of Mason about city utilities for a potential hyperscale data center in neighboring Vevay Township, and officials have discussed a Public Act 425 conditional land transfer or annexation as possible paths. The township board adopted a data-center moratorium in February 2026, and its Planning Commission is drafting a data-center ordinance covering setbacks, building size, road access, farmland, screening, and lighting.
- **Eagle Township, Clinton County, near Grand Ledge**The Township Board adopted a data-center moratorium on Feb. 17, 2026 so the Planning Commission can study zoning changes; township records list it through Feb. 17, 2027.
- **Ohio spillover watch**On Nov. 3, 2026, Ohio voters in 18 municipalities decided 21 local data-center measures, more than half of the 41 on ballots nationwide, and every Ohio result went against new data-center development, from outright bans to voter-approval and financial-guarantee rules. With that many Ohio doors closing at once, developers hunting for power, land, and water are expected to look harder at southeast Michigan and the I-94 and I-96 corridors, which is why the decisions below matter here.

### The case for and against

#### The case for data centers

- **Rules beat a blank slate**Mason's own records note that repealing the M-3 district did not stop data centers from locating in the city; it left them under general manufacturing rules written for ordinary factories. The case for purpose-built rules is that they add noise, setback, berm, and utility protections a community otherwise cannot require. [Official reference](https://www.mason.mi.us/how_do_i_/learn_about/m-3_technology_innovation_district/index.php)
- **State guardrails on the grid**Michigan regulators have required very large new customers of 500 megawatts or more to be first in line for load shedding during certain grid emergencies, and have conditioned recent data-center contracts on keeping costs off other customers. [Official reference](https://www.michigan.gov/mpsc)

#### The case against

- **Voters want the final word**Mason residents gathered 755 valid signatures to force a referendum, then recalled a council member who backed the M-3 district. The message from mid-Michigan voters is that decisions this big should not move faster than residents can follow. [Official reference](https://clerk.ingham.org/)
- **Decisions that cross boundaries**A hyperscale request in Vevay Township seeking Mason city utilities, with talk of a Public Act 425 land transfer or annexation, shows how one community's choice can land on its neighbors. Moratoriums in Vevay and Eagle townships buy time, but they end. [Official reference](https://www.vevaytownship.org/)
